‘Pick a Picket’ Campaign

By participating in the Pick a Picket Campaign and donating to the Cricket Victoria Foundation, you agree to be bound by the following terms and conditions.

1.         Definitions

1.1 Cricket Victoria refers to Victorian Cricket Association trading as Cricket Victoria (ABN 28 004 128 812), with its registered address at CitiPower Centre – Junction Oval, Lakeside Drive, St Kilda VIC 3182.

1.2 Cricket Victoria Foundation refers to Cricket Victoria’s philanthropic project auspiced under the Australian Sports Foundation guidelines.

1.3 Donor refers to the individual or entity making a donation to the Pick a Picket Campaign.

1.4 Pick a Picket Campaign refers to the fundraising initiative of the Cricket Victoria Foundation to raise funds for areas including accessibility, delivering opportunities for culturally diverse communities, supporting the growth of women and girls’ cricket and additional development programs both on and off field.

1.5 Picket refers to an individual picket located at the CitiPower Centre (Junction Oval), on which a plaque is or may be etched with the Donor’s selected name, as recognition for their contribution in accordance with these terms and conditions.

1.6 Recognition Period means the period of time during which the plaque remains on the Picket remains in place as set out in Section 4.1 and otherwise in accordance with these terms and conditions.

2.         Donation

2.1 Purpose All funds raised through the Pick a Picket Campaign will directly support the initiatives set out in Section 1.4.

2.2 Types of Pickets The following options are available for donation: 

·       Option 1: Your name, club or business exclusively etched into a plaque on a picket | $500.

·       Option 2: Your name alongside a current or former Victorian, Melbourne Stars or Melbourne Renegades player, excluding Australian players in Option 3 | $1000

·       Option 3: Your name alongside an Australian player from Victoria, the Melbourne Stars or the Melbourne Renegades | $5000

 

2.3 Option 2 and 3: Allocations of player names are strictly on the basis of earliest time of submission of a complete and valid application, including processing of payment (which application constitutes an offer to Cricket Victoria), following an initial invitation to the player and/or player’s family to make an application for the player’s name under Option 2 or 3 above. The Cricket Victoria Foundation (for Cricket Victoria and on behalf of any player) reserves the right to not accept an application in its discretion without providing reasons, in which case the Donor will be offered the opportunity to be associated with an alternate player.

If following the selection of a Picket with a player’s name, the player name is not available or the player chooses to no longer be acknowledged on the Picket or otherwise participate in the Pick a Picket Campaign, the Cricket Victoria Foundation will advise the Donor and offer the Donor the opportunity to select another player for the Donor’s name to appear alongside. Players may be added from time to time.

 

2.4 Etching: A Donor may apply in their own name, their family name, their company or club name (with the consent in writing of a duly authorised officer of the company or cub), A Donor may apply in the name of a person they wish to gift the Picket (plaque) to, but if the named person does not want their name on the Cricket Victoria CitiPower Centre Picket Fence, the Donor must advise the Cricket Victoria Foundation as soon as practicable and provide an alternate name (at the Donor’s cost, if any).

2.5 Review and reservation: Upon completion of the application process (including the selected name to be etched on the Picket), and any additional wording available (if any, including any optional wording made available by the Cricket Victoria Foundation) the Donor’s proposed wording will be reviewed and/or (subject to Sections 2.3 and this 2.4) approved by the Cricket Victoria Foundation.

The Cricket Victoria Foundation reserves the right in its sole discretion to reject or modify any proposed wording that it deems inappropriate, offensive, against the values and guidelines of the Pick a Picket Campaign, may constitute ambush marketing, is beyond the prescribed character limit or otherwise in its discretion, without providing reasons.

3.         Payment and Refunds

3.1 Payment Terms: Donations for the Pick a Picket Campaign can be made through the official website or by contacting the Cricket Victoria Foundation directly. All prices quoted are in Australian Dollars (AUD) and exclusive of GST.

3.2 Tax-Deductible Receipt: Donations made to the Cricket Victoria Foundation may be tax-deductible. The Donor may request a tax-deductible receipt for their donation, subject to eligibility and in accordance with applicable tax laws.

3.3 Refunds: Subject to applicable laws, Cricket Victoria Foundation will consider refund requests if made within 14 days of the donation and are subject to review. Approved refunds will be made by credit to the original payment method used.

4.         Recognition and Duration

4.1 Recognition Period: The Donor’s name or family name (or other approved name) will be etched onto the picket plaque for a period of 10 years from the date payment is processed. If the picket fence is relocated during this period, all Pickets will be relocated accordingly. The Donor acknowledges that the Recognition Period may be reduced without any liability on the part of Cricket Victoria (including the Cricket Victoria Foundation) due to circumstances beyond the Cricket Victoria Foundation’s control.

Further, if a named company, club, business or other entity is deregistered or becomes insolvent during the Recognition Period, the plaque (but not the Picket) will be removed and returned to the recorded or registered address of the entity and any associated player will be offered the opportunity to be associated with another Donor. To avoid doubt, the Picket is not transferable and cannot be bequeathed to another under a will.

4.2 Renewal: At the end of the Recognition Period, the Donor’s existing rights of recognition cease. The Cricket Victoria Foundation may, in its discretion, offer the donor the opportunity to renew their Picket for an extended period, subject to the continuation of the Pick a Picket Campaign

4.3 Picket Location: The location of the Donor’s Picket may be selected by the Donor pending Picket availability. The Cricket Victoria Foundation reserves the right to withhold picket numbers for the purposes of future signage or for other CitiPower Centre operational purposes. The Donor may select which picket number (1-2734) they would prefer their plaque to appear on. If the Picket has not already been selected or is unavailable due to permanent venue signage or other operational purposes, the Donor’s plaque will appear on it. Please note if a preferred number is already taken or reserved by the Cricket Victoria Foundation, the Cricket Victoria Foundation will work with the Donor to find an available Picket number for the plaque.

 

5.         Damage and Maintenance

The Cricket Victoria Foundation will undertake reasonable efforts to maintain the Picket plaques and repair any material damage incurred during the Recognition Period.

6.         Privacy and other laws

6.1 Privacy: The Cricket Victoria Foundation will collect, use, disclose, store and process personal information provided by the Donor in accordance with applicable privacy laws and regulations and Cricket Victoria’s Privacy Policy (https://www.pickapicket.com.au/privacy-policy/)

6.2 Compliance with laws: In addition to Section 6.1, the Donor acknowledges and agrees all information provided in relation to their application will be true and correct, without misrepresentation, and that the Donor will otherwise comply with all laws, regulations, these terms and conditions and applicable policies related to the Pick a Picket Campaign.

7.         Amendment and Termination

7.1 The Cricket Victoria Foundation reserves the right to amend these terms and conditions in its discretion. The Cricket Victoria Foundation also reserves the right to amend or terminate the Pick a Picket Campaign, including these terms and conditions, in its sole discretion. In the event of termination, Cricket Victoria will make reasonable efforts to communicate with Donors regarding the availability of the plaques from their Pickets.
